      Will my creditors show up at my 341 meeting?

    As a Chicago bankruptcy attorney, I am often asked by clients whether or not creditors show up at their meeting of creditors or the 341 meeting. The answer is generally no, they do not appear at your meeting of creditors whether it is a Chapter 7 or a Chapter 13 filing. The reason for this is that the trustee does most of what any creditor would do in the case by asking questions about assets.

    It is extremely rare that a creditor or really a creditors attorney will appear at a meeting of creditors. The only time it will generally happen is if the Debtor has committed fraud in the bankruptcy or is suspected of it (such as running credit cards or debts up right before filing, transferring or hiding assets in the case, or a regular person gets the bankruptcy notice and just doesn't understand it). In my 8 years of practice as a Chicago bankruptcy lawyer I would say that of the numerous cases I have filed over the years only a very small proportion way less than 1% have a creditor show up in the case.
