      My car was taken by the City of Chicago!

    If you owe parking tickets (a significant amount) the City of Chicago can take your car to one of the impound lots because of the tickets. The City will often boot the car first and then send the tow truck out. As a Chicago bankruptcy attorney, I will get the question what should I do? Parking tickets are non-dischargeable in a Chapter 7 so you can get the car out of the pound by filing a Chapter 7, but the City can take the car again once the discharge is entered and the stay is no longer in effect.

    A Chapter 13 may be a better option to repay creditors including the City of Chicago over time and keep the car from being taken again while the case is pending for up to five years. It is important to know the date the car will "disposed" of prior to filing a Chapter 13 bankruptcy, because the City will either sell the car or crush the car at a certain date after they take it. Once the car is crushed or disposed of it is too late to get it back. If you have a lien on the vehicle they normally contact the lender to let them get the car out of the pound, but sometimes the lender doesn't get the car. Then two problems can arise you still have parking tickets and no car and the lender will come after you for the balance owed.
