My spouse does not want to file bankruptcy. Do they have to file with me?

As a Chicago bankruptcy attorney, I will commonly get the question of whether a persons spouse has to file bankruptcy with them. Often times one spouse will want to file and the other does not. The answer is no, the spouse who does not want to file bankruptcy does not have file if they choose not to. However, in most cases the spouses income is listed if the married couple is living together and a joint budget will be used.
In addition, a Chicago bankruptcy lawyer will have to proof of the other spouses income. I often will tell a potential client to bring in their spouse whether or not they want to file, because they so often will have questions even if they are not filing bankruptcy.
