      My License is Suspended for Parking Tickets! What should I do?

    As a Chicago Bankruptcy Attorney I will often meet with clients who have a few or a lot of parking tickets. Parking tickets in the City of Chicago are not discharged by the discharge in a Chapter 7. A Chapter 7 will only give temporary relief from the collection and suspension of a driver's license for parking tickets, while the stay is in effect for approximately four months. If the person who I am meeting with has only a few tickets, a Chapter 7 bankruptcy may be the best course of action for them. However, for a person who has a lot of parking tickets, generally over a couple of thousand dollars and who is working and uses their driver's license to go back and forth to work, a Chapter 13 bankruptcy is generally the best course of action. If you are unsure how much you have in parking tickets you can search the City of Chicago Parking Tickets website to find tickets issued in the City of Chicago.

    A Chapter 13 is a bankruptcy reorganization that consolidates all the person's debt into one payment including any non-dischargeable debts into the plan or reoganization. If the Debtor's license is suspended then the automatic stay and the filing of a Chapter 13 will release the license for the pendancy of the bankruptcy case! This release of the license for the duration of the case allows the debtor to repay a portion or all of their parking tickets for up to five years, while allowing them to drive their vehicle to earn their income. The City of Chicago and other municipalities in the Chicago area have become rather aggressive for the collection of past due parking tickets, and the fines and tickets even double! So if your license is suspended and you are working, a Chapter 13 bankruptcy may be the best course of action for your situation.
